Abandoned Sign

A sign which no longer correctly directs or exhorts any person, nor advertises a bona fide business, lessor, owner, product, or activity currently being conducted or product currently available.

Abate

To repair, replace, remove, destroy or otherwise remedy the condition in question by such means and in such manner and to such an extent as the City Manager/designee determines is necessary to bring the condition into compliance with the City Code in the interest of the general health, safety and welfare of the community.

Accessory Building

One (1) which is subordinate and customarily incidental to and on the same lot with a main building, including a private garage but not involving any activity used for commercial purposes. Greenhouses and/or hydroponic houses for hobby purposes shall be excluded for this definition.

Acreage Gross

The acreage within the perimeter of a development tract, plus one-half (1/2) of the right-of-way of all adjoining streets and alleys

Administrator

As used in this chapter means the Director of the Municipal Utilities Department or designee.

Adult

A person who has attained the age of eighteen (18) years.

Adult bookstore

A commercial establishment:
(a) Which, as one (1) of its principal business purposes, offers for sale or rental, for any form of consideration, books, magazines, periodicals, or other printed matter that depict or describe "specified sexual activities" or "specified anatomical areas"; or
(b) Which offers for sale or rental instruments, devices, or paraphernalia that are designed for use in connection with "specified sexual activities" excluding condoms and other birth control and disease prevention products; or
(c) Which regularly excludes all minors from the premises or a section thereof because of the sexually explicit nature of the items sold, rented or displayed therein.

Adult Care Home

A residential care institution, licensed by the Arizona Department of Health Services, which provides supervisory care, personal care, or custodial care services to not more than ten (10), nor less than six (6), adults who are unrelated to the manager or owner of the home and who require the assistance of no more than one (1) person to walk or to transfer from a bed, chair, or toilet, but who are able to self-propel a wheelchair.

Adult Live Entertainment Establishment

(Repealed by Ord. No. 2413, § 1.A, 11-18-93).

Adult Service

A dance, performance or other activity, including, but not limited to, service of food or beverages, modeling, posing, wrestling, singing, reading, talking, or listening conducted for any consideration in an adult service business by a person who is nude during all or part of the time that the person is providing the service. (Ord. No. 2413, § 1.C, 11-18-93)

Adult Service Business

A commercial establishment where any adult service is provided to patrons in the regular course of business and as one (1) of the principal business purposes of the establishment.

Adult Theatre

(Repealed by Ord. No. 2413, § 1.A, 11-18-93)

Adult Video Facility

A commercial establishment where, for any consideration, films, motion pictures, video cassette projections slides, photographs or other visual media characterized by depiction of "specified sexual activities" or "specified anatomical areas" are shown in the regular course of business and as a principal business purpose of the establishment. "Adult video facility" does not include a theater where all viewing occurs in a common area with seating for fifty (50) or more persons.

ADWR

Arizona Department of Water Resources.

Agriculture

Use of land for the production of food and fiber, including the growing of crops and/or the grazing of animals on natural prime or improved pasture.

Agriculture/Urban Farm Areas

Agriculture/Urban Farms may be privately or publicly owned urban farms. Urban Farms are typically small farms that may grow fruits, vegetables, organic crops, flowers or other crop. They are not large-scale, single-crop farms.

Airport-Related Definitions

(a) Airport,
A parcel of land designed and set aside for the operation, servicing, maintenance, and sale of aircraft.

(b) Airport Noise: Accidental Potential and Clear Zone Map,
A map detailing specific airport noise and accidental potential overlay areas and clear zone areas and is hereby incorporated by this reference and is a part of the official zoning code of the City of Chandler for the purpose of establishing various land uses and design criteria within the airport impact overlay district, and is available in the Office of the Airport Manager and of the Planning Director.

(c) Airport Noise Overlay Area One (1) (ANO-1)
The area between the sixty-ldn and sixty-five-ldn noise contour lines developed by the application of day-night average sound level methodology of sound measurement (ldn).

(d) Airport Noise and Accident Potential Overlay Area Two (2) (ANO-2)
Means the area between the sixty-five-ldn and seventy-ldn noise contour lines developed by the application of day-night average sound level methodology of sound measurement (ldn).

(e) Airport Noise and Accident Potential Overlay Area Three (3) (ANO-3)
Means the area between the seventy-ldn and seventy-five-ldn noise contour lines developed by the application of day-night average sound level methodology of sound measurement (ldn).

(f) Clear Zone
Means an area on either side of an extension of the centerline of a runway beginning at a line two hundred (200) feet from the end of a runway and, for Runway 4L-22R of the Chandler Municipal Airport: two hundred fifty (250) feet wide and flaring outward to a width of four hundred fifty (450) feet at a distance of one thousand (1,000) feet; for Runway 4R-22L of the Chandler Municipal Airport: five hundred (500) feet wide and flaring outward to a width of one thousand ten (1,010) feet at a distance of one thousand seven hundred (1,700) feet; for Runway 35-17 of the Stellar Airpark: two hundred fifty (250) feet wide and flaring outward to a width of four hundred fifty (450) feet at a distance of one thousand (1,000) feet.

(g) Day-night Sound Level Contour, ldn:
Is a computed noise which uses sound exposure levels (SEL) which is computed by numerically integrating the sound pressure level versus the time history of each operation measured. This data is then converted to ldn by taking the energy average SEL at reference measurement points for all aircraft. The ldn concept defines the day-night level as a series of hourly noise levels for a given day, weighted for time of occurrence. Residential uses are not normally acceptable in areas with ldn sixty (60) or greater unless the residences are properly sound attenuated. Mobile homes and recreational vehicles cannot normally be sound attenuated.

(h) Decibel
Means the physical unit commonly used to describe noise levels.

(i) High Noise Levels
Means sound levels, which equal or exceed that within the sixty-ldn noise contour line developed by the application of the day-night average sound level methodology of sound measurement (ldn).

(j) Principally Permitted Use or Structure
A use or structure which determines the primary or predominant use of the lot on which it is located.

Alley

A public thoroughfare which affords only a secondary means of access to abutting property.

Alley, Major

Twenty (20) feet in width serving multifamily residential, commercial and industrial developments.

Alley, Minor

Sixteen (16) feet in width serving single- and two-family residential development.

Amusement arcade

Any building or portion thereof having its primary use devoted to mechanical amusement devices and/or vending machines.

Annexation

To incorporate a land area into an existing district or municipality, with a resulting change in the boundaries of the annexing jurisdiction.

Apartment house

Any building, or portion thereof, which is designed, built, rented, leased, let, or hired out to be occupied, or which is occupied as the home or residence of three (3) or more families living independently of each other and doing their own cooking in the said building, and shall include flats and apartments. (See "dwelling, multiple").

Appraiser

Any licensed person, firm or corporation whose primary occupation or service is the erection, installation, renovation or alleviation of signs in the State of Arizona.

Approved

Accepted by the Director of Public Works as meeting an applicable specification stated or cited in this article, or as suitable for the proposed use.

Area

An area of a city that has a unique character identifiable as different from surrounding areas because of distinctive architecture, streets, geographic features, culture, landmarks, activities, or land uses.

Arterial

Medium-speed (30-40 mph), medium-capacity (10,000-35,000 average daily trips) roadway that provides intra-community travel and access to the countywide highway system. Access to community arterials should be provided at collector roads and local streets, but direct access from parcels to existing arterials is common.

Attached Sign

Any sign, which is attached, fastened, connected or supported in whole or in part by a building or structure other than a sign structure, which is supported wholly by the ground.

Auxiliary Water Supply

Any water supply on or available to the premises other than the City's approved public potable water supply. These auxiliary waters may include water from another purveyor's public potable water supply or any natural source(s) such as well, spring, river, stream, treated effluent, wastewaters, etc., or "used waters" or "industrial fluids." These waters may be polluted or contaminated or they may be objectionable and constitute an unacceptable water source over which the City does not have sanitary control.

AZ Tech Model Development

A seven-year project that uses cutting edge technology to improve traffic conditions for the Phoenix Metropolitan Area.

Back-pressure

The flow of water or other liquids, mixtures or substances under pressure into the distribution pipes of a potable water supply system from any source or sources other than its intended source.

Back-siphonage

The flow of water or other liquids, mixtures, or other substances into the distribution pipes of a potable water supply system from any source or sources other than its intended source caused by the sudden reduction of pressure in the potable water supply system.

Backflow

The reversal of the normal flow of water caused by either back-pressure or back-siphonage.

Backflow Prevention Assembly

A device or means designed to prevent backflow:

(a) Air-gap, The unobstructed vertical distance through the free atmosphere between the lowest opening from any pipe or faucet supplying water to a tank, plumbing fixture, or other device and the flood level rim of the vessel. An approved air-gap shall be at least double the diameter of the supply pipe, measured vertically, above the top of the overflow rim of the vessel, and in no case less than one (1) inch.
(b) Reduced pressure principle device: An assembly of two (2) independently operating approved check valves with an automatically operating differential relief valve between the two (2) check valves, tightly closing shutoff valves on either side of the check valves, plus properly located test cocks for the testing of the check and relief valves. The entire assembly shall meet the design and performance specifications and approval of a recognized and City-approved testing agency for backflow prevention assemblies. The device shall operate to maintain the pressure in the zone between the two (2) check valves at a level less than the pressure on the public water supply side of the device. At cessation of the normal flow the pressure between the two (2) check valves shall be less than the pressure on the public water supply side of the device. In case of leakage of either of the check valves, the differential relief valve shall operate to maintain the reduced pressure in the zone between the check valves by discharging to the atmosphere. When the inlet pressure is two (2) pounds per square inch or less, the relief valve shall open to the atmosphere. To be approved, these devices must be readily accessible for in-line maintenance and testing and be installed in a location where no part of the device will be submerged. An acceptable method of handling discharge water from the device must be approved by the Director of Public Works.
(c)Double check valve assembly: An assembly of two (2) independently operating approved check valves with tightly closing shutoff valves on each end of the check valve. The entire assembly shall meet the design and performance specifications and approval of a recognized and City-approved testing agency for backflow prevention devices. To be approved, these devices must be readily accessible for in-line maintenance and testing.
(d) Double check-detector check valve assembly: Means a specially designed assembly composed of a line-size approved double check valve assembly with a specific bypass five-eighths-inch by three-quarter-inch, or three-quarter-inch water meter and a three-quarter-inch approved double check valve assembly. The meter shall register all rates of flow. This assembly shall only be used to protect against a non-health hazard (i.e. pollutant).
(e) Pressure vacuum breaker assembly: An assembly containing an independently operating, loaded check valve and an independently operating, loaded air inlet valve located on the discharge side of the check valve. The assembly shall be equipped with properly located test cocks and tightly closing shutoff valves located at each end of the assembly.
(f) Atmospheric vacuum breaker: Also known as the "non-pressure type vacuum breaker," shall mean an assembly containing a float check, a check seat and an air inlet port. The flow of water into the body causes the float to close the air inlet port. When the flow of water stops, the float falls and forms a check valve against back siphonage and at the same time opens the inlet port to allow air to enter and satisfy the vacuum. A shutoff valve immediately upstream may be an integral part of the assembly. An atmospheric vacuum breaker is designed to protect against a health hazard (i.e. contaminant) under a back-siphonage condition only.

Banner

A temporary sign of fabric, plastic, paper or other light pliable material not enclosed in a rigid frame, and mounted so as to allow movements of the sign by atmospheric conditions.

Basement

That portion of a building between floor and ceiling, which is partly below and partly above grade (as defined in this chapter) but so located that the vertical distance from grade to the floor below is less than the vertical distance from grade to ceiling. (See "story"). >Benefit Study

A report adopted by the City Council setting forth the required regional infrastructure necessary for the full development of undeveloped or partially developed lands within a specific study area. The report shall identify each property division existing at the time of its preparation and shall set forth the specific obligation of each property, which includes its fair share of the required common infrastructure in the area. The limits of the study area shall be determined by the City Engineer based on arterial street requirements for a fifteen-year period.

Bicycle Lanes

These are on-street facilities, typically 5.5 feet wide, designed for bicycle, created by means of pavement striping.

Billboard

A structure portraying information not related to a business, commodity, service, entertainment or product existing on the premises upon which the sign is located.

Block

At least seven hundred (700) feet of street frontage, including rights-of-way.

Block

A piece or parcel of land or group of lots entirely surrounded by public streets, subdivision lines, irrigation canals, highways, streams, railroads or parks, or a combination thereof.

Boardinghouse

A building where, for compensation and by pre-arrangement for definite periods, meals, or lodging and meals, are provided for three (3) or more persons, but not exceeding twenty (20) persons.

Bond

An interest-bearing promise to pay a stipulated sum of money, with the principal amount due on a specific date. Funds raised through the sale of bonds can be used for various public purposes.

Branch Sewer

A sanitary sewer of fifteen-inch diameter or smaller that receives wastewater from a relatively small area and discharges into a sewer main serving more than one (1) branch sewer area.

Buffer Zone

An area of land separating two distinct land uses that acts to soften or mitigate the effects of one land use on the other.

Building

Any structure used or intended for supporting or sheltering any use or occupancy.

Building Front Foot

The distance measured along the property line on which the lot fronts. In the event that a building fronts on two (2) or more streets, one (1) of which is primarily residential, the property owner shall be given the option of selecting one (1) street frontage for the purpose of computing allowable sign area. For corner lots abutting arterial streets, the owner may use both streets for computing sign area.

Building Height

The vertical distance above "grade" as defined herein to the highest point of the coping of flat roof or to the deck line of a mansard roof or to the average height of the highest gable of a pitched or hipped roof. The measurement may be taken from the highest adjoining sidewalk or ground surface within a five-foot horizontal distance of the exterior wall of the building, when such sidewalk or ground surface is not more than ten (10) feet above grade. The height of a stepped or terraced building is the maximum height of any segment of the building.

Building Service Line

Piping which extends from the end of the building drain and which receives the discharge of the building drain and conveys it to the public sewer. The building service line shall consist of all piping from the owner's home or building, both on the owner's property and the City right-of-way, down to and including the tap and tapping saddle on the City sewer main.

Building setback line

The line indicated by the minimum permitted horizontal distance between the street right-of-way and building(s) or any projections thereof, other than steps, eaves, chimneys, bay windows and fire escapes.

Building Setback Line

The line indicated by the minimum permitted horizontal distance between the street right-of-way line and building(s) or any projections thereof, other than steps, eaves, chimneys, bay windows and fire escapes.

Bulk plant

Property where flammable, combustible and toxic liquids are received by tank vessel, pipelines, tank car, or tank vehicle and are stored or blended in bulk for the purpose of distributing such liquids by tank vessel, pipeline, tank car, tank vehicle or container.

Business Front Foot

The lineal distance of a building measured along a straight line parallel to the street. Where a building is not parallel to the street, the front foot shall be measured along the exterior front wall of the building.

Business or Commercial Establishment

Any public or private place, building or enterprise utilized for the conduct of business or industrial enterprise. Multi-family housing with four (4) or more units, hotels, motels, motor inns, and other like establishments providing lodging for travelers, long-term care facility/nursing homes and nonprofit organizations are business establishments.

Business, Outdoor Type

A business in which all or most of the business is conducted or items displayed in an open area subject to the zoning codes of the City of Chandler.

Cable Services

The one (1) way transmission to subscribers of video programming and other programming services, together with subscriber interaction, if any, which is required for the selection of such programming and programming services.

Camper

A mobile living unit designed to be mounted upon and conveyed by another vehicle. No camper unit shall be occupied within the City of Chandler except as provided in Article XI of this Code.

Capacity

The maximum rate of flow that can be carried by a sewer.

Capital improvement

Land or facilities for the production, storage, treatment or distribution of water; for the collection, treatment, reclamation or disposal of sewage; for purposes of transportation and transit, including without limitation, streets, street lighting and traffic-control devices and supporting improvements, roads, overpasses, bridges, airports, and related facilities; for parks and recreational improvements; for public safety, including police and fire facilities; for libraries; for public buildings of all kinds; and for any other capital project identified in the City's Infrastructure Master Plans or Capital Improvements Plan. "Capital improvement" also includes design, engineering, inspection, testing, planning, legal, land acquisition, and all other costs associated with construction of a public facility.

Capital Improvements Program (CIP)

A program, administered by a city or county government and reviewed by its legislative body, which schedules permanent improvements, usually for a minimum of five years in the future, to fit the projected fiscal capability of the local jurisdiction. The program generally is reviewed annually, for conformance to and consistency with the general plan.

Carport

A roofed structure with two (2) or more open sides under which a vehicle may be driven.

Cellar

That portion of a building between floor and ceiling which is wholly or partly below grade (as defined in this section) and so located that the vertical distance from grade to the floor below is equal to or greater than the vertical distance from grade to ceiling. (See "story").

Central Business District

The commercial center of a community and typically, the historic origin for subsequent growth of the community.

Certified Tester

A person who has proven competency to the satisfaction of the Director of Public Works. Each person certified to make competent tests or to repair, overhaul and make reports on backflow prevention assemblies shall be conversant with the applicable laws, rules and regulations and have had experience in plumbing or pipe fitting or have other qualifications which are equivalent in the opinion of the Director of Public Works.

City Campuses

A group of city buildings and services that complement each other, including pedestrian links and plazas.

City General Plan

A general plan, or parts thereof, providing for the future growth and improvement of the City of Chandler, and for the general location and coordination of streets and highways, schools and recreation areas, public building sites and other physical development, which shall have been duly adopted by the City Council (sometimes referred to as a "comprehensive plan").

City Service

Service to City-owned buildings, facilities, parks and properties.

City's Water Distribution System

The infrastructure that enables water to be delivered from its source to the user.

Clear Zone

Means an area on either side of an extension of the centerline of a runway beginning at a line two hundred (200) feet from the end of a runway and, for Runway 4L-22R of the Chandler Municipal Airport: two hundred fifty (250) feet wide and flaring outward to a width of four hundred fifty (450) feet at a distance of one thousand (1,000) feet; for Runway 4R-22L of the Chandler Municipal Airport: five hundred (500) feet wide and flaring outward to a width of one thousand ten (1,010) feet at a distance of one thousand seven hundred (1,700) feet; for Runway 35-17 of the Stellar Airport: two hundred fifty (250) feet wide and flaring outward to a width of four hundred (450) feet at a distance of one thousand (1,000) feet.

Cluster Housing

Any type of dwelling units located in a planned development which are constructed on lots or a site having an area less than required by the district regulations and sharing common approved open space. The overall density of housing units for such developments is in compliance with the district regulations.

Collection

The point at which the development fee/charge is actually paid to the City.

Collector Street

Relatively low-speed (25-30 mph), relatively low-volume (5,000-20,000 average daily trips) street that provides circulation within and between neighborhoods. Collectors usually serve short trips and are intended for collecting trips from local streets and distributing them to the arterial network.

Combustible Waste

Miscellaneous burnable materials, or the organic component of refuse.

Commercial

A land use classification that permits facilities for the buying and selling of commodities and services.

Commercial Building

A building or group of buildings upon a lot or group of adjoining lots, having common ownership designed for any commercial purpose other than multifamily dwellings. Any building or group of buildings where combined residence and business is practiced, where such business is advertised by a sign of any type on the premises and/or listed in the telephone directory as a business, shall be classified as commercial. Commercial building shall include hotel, motel, tourist courts, rooming houses or any establishment catering to transient residents.

Commercial Building, Multiple-tenant

A commercial building or development in which exists two (2) or more separate commercial activities, where appurtenant-shared facilities exist (such as parking or pedestrian mall, and which is designed to provide a single area in which the public can obtain varied products and services). Distinguishing characteristics may but need not include common ownership of the real property, common wall construction or multi-occupant commercial use of a single structure.

Commercial Hauler

Any person, company or organization engaged in the collection, removal, transporting or hauling of any solid waste, recyclable material or any other types of waste including hazardous and medical, on or along any public street, avenue or alley within the jurisdictional boundaries of the City of Chandler. >Commercial Mobile Radio Services

Two-way voice commercial mobile radio services as defined by the Federal Communications Commission in 47 United States Code Section 157.

Commercial Sanitation Service

Refuse collection service provided to any business establishment.

Commingled Curbside Recycling

The process of combining approved recyclable materials and placing them into a City-provided container for collection and recycling.

Commission

City of Chandler Planning and Zoning Commission.

Community Park

A publicly owned land site, usually in the range of 25 to 50 acres in size, with full public access intended to provide recreation opportunities beyond those supplied by neighborhood parks. Community parks are larger in scale than neighborhood parks but smaller than regional parks.

Conditional approval

An affirmative action by the Commission and/or the Council indicating that approval is granted conditioned upon satisfaction of and compliance with certain specified stipulations.

Condominium

An estate of real property consisting of an undivided interest in common in a portion of a parcel of real property together with a separate interest in air space in a residential, industrial or commercial building on such real property, such as an apartment, office or store.

Connection Charge

Charge made for connection to the City Wastewater System.

Conservation

The management of natural resources to prevent waste, destruction, or degradation.

Construction and Demolition Wastes

All waste building materials, rubble and spoils resulting from construction, remodeling, repair, and demolition operations on any building or structure.

Contamination

An impairment of the quality of the potable water by sewage, industrial fluids, waste liquids, compounds or other materials to a degree which creates an actual or potential hazard to the public health through poisoning or through the spread disease.

Convalescent home

Includes rest homes, nursing homes, and convalescent homes for children, and homes providing chronic and convalescent care.

Council

The City Council of the City of Chandler.

Court

A space, open and unobstructed to the sky, located at or above grade level on a lot and bounded on three (3) or more sides by walls of a building.

Cross-connection

Any physical connection or arrangement of piping or fixtures between two (2) otherwise separate piping systems, one (1) of which contains potable water and the other non-potable water or industrial fluids of questionable safety, through which or because of which backflow may occur into the potable water system. A water service connection between a public potable water distribution system and a customer's water distribution system which is cross-connected to a contaminated fixture, industrial fluid system or with a potentially contaminated supply or auxiliary water system, constitutes one (1) type of cross-connection. Other types of cross-connections include connectors such as swing connections, removable sections, four-way plug valves, spools, dummy sections of pipe, swivel or change-over devices, sliding multi-port tube, solid connections, etc.

Cross-connection Control by Containment

The installation of an approved backflow prevention device at the water service connection to any customer's premises where it is physically and economically unfeasible to find and permanently eliminate or control all actual or potential cross-connections within the customer's water system, or it shall mean the installation of an approved backflow prevention device on the service line leading to and supplying a portion of a customer's water system where there are actual or potential cross-connections which cannot be effectively eliminated or controlled at the point of cross-connection.

Cross-connections Controlled

A connection between a potable water system and a non-potable water system with an approved backflow prevention device properly installed and maintained so that it will continuously afford the protection commensurate with the degree of hazard.

Curbline

The line at the face of the curb nearest the street or roadway. In the absence of a curb, the curbline shall be determined by the City Engineer.

Current Cost (also current front foot cost)

Costs involved in construction of a waterline, including engineering, construction and inspection, usually given as a per foot cost; established annually so as to reflect the most recent costs derived from local bids and contractors' and suppliers' price quotations.

Debris, Junk, and/or Trash

Broken glass, broken concrete, broken plaster or gypsum board, scrap lumber, siding or roofing material, ceiling tile or floor covering material, broken asphalt materials, or broke concrete, clay, tile or plastic pipe or any similar scrap building or construction materials.

Decibel

The physical unit commonly used to describe noise levels.

Dedication

The turning over by an owner or developer of private land for public use, and the acceptance of land for such use by the governmental agency having jurisdiction over the public function for which it will be used.

Density, Gross

Gross acreage divided into the number of units, lots or spaces.

Density, Net

Net acreage, excluding streets, alleys and other rights-of-way divided into the number of units, lots or spaces.

Density, Residential

The number of dwelling units per acre.

Department

The Planning and Development Department of the City of Chandler.

Department

A Department, Division or City employee to whom responsibility for the administration of this chapter has been delegated by the City Manager. Generally the Department will be the City Engineer or the Director of Planning and Development and persons seeking permits pursuant to this chapter may obtain necessary forms and information from the permit counter in the Planning and Development Department.

Design Review; Design Control

The comprehensive evaluation of a development and its impact on neighboring properties and the community as a whole, from the standpoint of site and landscape design, architecture, materials, colors, lighting, and signs. "Design Control" requires that certain specific things be done and that other things not be done. Design Control language is most often found within a zoning ordinance. "Design Review" usually refers to a system set up outside of the public hearing process, whereby projects are reviewed against certain standards and criteria by a specially established design review board or committee.

Detention/Retention Basins

Retention basins are principally designed to retain the runoff from a 100-year, 2-hour storm. These areas may be landscaped and used during non-storm periods for passive or active recreation. Any facilities placed in these areas require special care in placement to ensure that they are not inundated, except during the infrequent storm events.

Developer

Any person or persons, corporation, partnership or firm desiring reclaimed water service

Developer

Any person or persons, corporation, partnership or firm desiring sewer service.

Developer

A developer shall be the individual, firm, corporation, association, syndicate, trust, or other legal entity that files the application and initiates proceedings for the development of land including but not limited to a subdivision, minor division of land, site development plan and/or a zone change in accordance with this Code. Developer shall also include a subdivider as defined in Chapter 48. The developer need not be the owner of record of the land.

Developer

Any person or persons, corporation, partnership or firm desiring municipal water service.

Development

The physical extension and/or construction of urban land uses. Development activities include: subdivision of land; construction or alteration of structures, roads, utilities, and other facilities; grading; and clearing of natural vegetative cover (with the exception of agricultural activities). Routine repair and maintenance activities are exempted.

Development Fee/Charge

A monetary exaction imposed by the City pursuant to this chapter as a condition of or in connection with approval of a development project for the purpose of defraying all or some of the City's cost or repaying costs previously expended from other City funds or capital improvements.

Development Master Plan (DMP)

A preliminary master plan for the development of a large or complicated land area, the platting of which is expected in progressive stages. A development master plan may be designed by the subdivider or by the Department and shall be subject to Commission and Council approval.

Development or Development Project, New

Any project undertaken for the purpose of development, including without limitation, a project involving the issuance of a permit for construction, reconstruction, or change of use, but not a project involving the issuance of a permit to operate or to remodel, rehabilitate, reconstruct or improve an existing structure, which does not change the density or intensity of use, nor the rebuilding of a structure destroyed or damaged by an act of God, nor the replacement of one (1) mobile home with another on the same pad if no dwelling unit is added

Director of Public Works

Either the Director of the Public Works Department or the Director of the Municipal Utilities Department, depending on the department designated responsibility for the applicable function by the City Manager. In the absence of a specific designation of authority by the City Manager or in this Chapter, it will be the Director of the Municipal Utilities Department charged with enforcement of the provisions of this chapter.

Distribution System

The network of public waterlines sixteen (16) inches in diameter and smaller, which compose the basic grid and distribution system for Municipal water service.

District

Any area indicated on zoning map for specific uses for which certain regulations relative to height, area, etc., apply.

Division of Land

Any land division and shall include subdivisions, land splits, minor land divisions and maps of dedication but do not include lot line adjustments which do not create any new lot.

Driveway, Major

Any driveway, which intersects a major or minor arterial and serves the main parking area of a major generator, with all movements permitted.

Driveway, Minor

Any non-major driveway, which provides access to a major or minor arterial. The access can be full, i.e., all movements permitted, or with certain movements restricted.

Dust-free

Shall mean the property is maintained dust free by paving with one (1) of the following methods: (1) asphaltic concrete, (2) portland cement concrete, (3) a penetration treatment of asphaltic material and a seal coat of asphaltic binder and mineral aggregate, or (4) the equivalent of the above as approved by the Department of Public Works.

Dwelling

Any building or any portion thereof which is not an "apartment house," "lodging house" or a "hotel" as defined in this Code, which contains one (1) or two (2) "dwelling units" or "guest rooms," used, intended or designed to be built, used, rented, leased, let, or hired out to be occupied, or which are occupied for living purposes.

Dwelling Unit

One (1) or more rooms, or a portion of a room in a building, designed or intended to be used, or actually used, for occupancy by one (1) family for living and sleeping quarters and containing one (1) kitchen only, including a mobile home, but not hotel or motel units.

Dwelling Unit

A room or group of rooms (including sleeping, eating, cooking, and sanitation facilities, but not more than one kitchen), which constitutes an independent housekeeping unit, occupied or intended for occupancy by one household on a long-term basis for residential purposes.

Dwelling Unit

A single unit providing complete, independent living facilities for one (1) or more persons including permanent provisions for living, sleeping, eating, cooking and sanitation.

Dwelling, Multifamily

A building or group of buildings located upon a lot or group of adjoining lots having common ownership served by common water meters, designed for occupancy by two (2) or more families such as duplexes, triplexes, multiplex apartments, condominiums, townhouses and trailer or mobile home parks.

Dwelling, Multiple

A building or portion thereof designed for occupancy by three (3) or more families.

Dwelling, Single-family

A building designed for occupancy by one (1) family.

Dwelling, Townhouse

Building that has not less than three (3) nor more than eight (8) single-family housekeeping units erected in row as a single building, on adjoining lots, each being separated from the adjoining unit or units by an approved masonry party wall or walls extending from ground floor to roof along a dividing lot line, and each such building being separated from other buildings by required yard areas.

Dwelling, Two-family

A building designed for occupancy by two (2) families.

Easement

Usually the right to use property owned by another for specific purposes or to gain access to another property. For example, utility companies often have easements on the private property of individuals to be able to install and maintain utility facilities.

Easement, Conservation

A tool for acquiring open space with less than full-fee purchase, whereby a public agency buys only certain specific rights from the landowner. These may be positive rights (providing the public with the opportunity to hunt, fish, hike, or ride over the land), or they may be restrictive rights specified by the owner, limiting the uses which the land may be devoted to in the future.

Elderly Care Housing

Single or multiple dwellings intended solely for occupancy and use by senior citizens who require or choose a residential community environment providing limited/special care, amenities and features associated with the needs and lifestyles of the elderly. May comprise part of a project providing intensive or congregate care. Incorporation of features such as those enumerated below will be indicative of the project's suitability as elderly care housing; prior to approval, the approving authority shall make finding that in their opinion there are sufficient such features for the project to be considered elderly care housing:
(1) Accessible central dining area(s).
(2) Recreation coordinate and/or program.
(3) Association accesses (by van available, etc.).
(4) Ramps and/or elevators.
(5) Electric appliances with safety features.
(6) Wide doors.
(7) Nonskid floors, tubs, walkways.
(8) Central heating with individual controls.
(9) Handle-type knobs.
(10) Emergency signal to central location/911.
(11) Grab bars-toilets, tubs, etc.
(12) Cable T.V.
(13) Braille signage.
(14) Library.
(15) Street furniture.
(16) Occupancy restrictions.
(17) Applicable licensing.
(18) Sprinkler systems (indoor).
(19) Electrical outlets elevated.
(20) Laundry service.
(21) Physician/nurse on call.
(22) Security.
(23) Housekeeping available.
(24) Private garden space.
(25) Common open space for walking and passive recreation, including walkways, benches for seating, and shade.
(26) Any other feature lending to the convenience, safety, character, function, or identity of the elderly care housing community. All common facilities shall be located within two hundred (200) feet for seventy-five (75) percent of the dwelling units. Due to decreased impact on infrastructure, density can be increased fifty (50) percent over what is prescribed by the governing district.

Encroach or encroachment

Includes but is not limited to, the performance of any of the following acts:
(a) Excavating, filling or disturbing the surface.
(b) Erecting or maintaining any flag, banner, decoration, post, sign, pole, fence, guardrail, wall, loading platform, news stand, mailbox, pipe, conduit, wire or other structure on, over or under the surface of any public place, highway or watercourse.
(c) Planting any tree, shrub, grass or other growing thing.
(d) Placing or leaving any rubbish, brush, earth or other material of any nature whatsoever.
(e) Constructing, placing, maintaining on, over or under the surface of any public place, right-of-way, street, pathway, sidewalk, driveway, curb, gutter, paving or other surface or subsurface drainage structure or facility, any pipe, conduit, wire, cable or telecommunication facility.
(f) Traveling by any vehicle or combination of vehicles or object of dimension, weight or other characteristic prohibited by law without a permit.
(g) Lighting or building a fire.
(h) Constructing, placing, planting or maintaining any structure, embankment, excavation or other objects adjacent to a right-of-way or watercourse, which causes or will cause an encroachment.
(i) The application of paint or other marking materials to any pavement or curb.

Equestrian Path

An easement located primarily in agrarian-type developments, which can be used as horse paths and other recreational purposes and for the installation of utilities. In no event shall a fence, wall or portion thereof be constructed in or over such easement.

Exception

Any parcel of land which is within the boundaries of the subdivision but which is not included in the subdivision

Facilities

The plant, equipment, and property, including but not limited to boxes, poles, wires, pipe, conduits, pedestals, antenna, and other appurtenances placed in, on, or under highways.

Facility Plans

Plans for public facilities such as wastewater.

Family

An individual or two (2) or more persons related by blood or marriage or a group of not more than five (5) persons (excluding servants) at least one (1) of whom is an adult, who need not be related by blood or marriage living together in a dwelling unit.

Farmer's Roadside Stand

Any building or structure used for the sale of articles grown or produced on the property.

Farming

Commercial agricultural uses in general and especially crop, dairy, stock and poultry farming; commercial greenhouses on three (3) acres or more.

Fascia

A parapet-type wall used as part of the fascia of a flat-roofed building and projecting not more than six (6) feet from the building face. Such a wall shall enclose at least three (3) sides of the project flat roof and return to a parapet wall or the building.

FCC

The Federal Communications Commission, or a designated representative.

Fire Line

A private waterline located primarily on private property, which is utilized exclusively for providing water to fixed fire protection systems.

Fixed Base Operator

A person, firm or corporation subject to the provisions of a lease engaging in more than two (2) of the following: (a) The sales, service, exchange, renting, and leasing of: (1) New and used aircraft; (2) Aircraft parts, accessories and hardware; (b) The repair, overhaul, maintenance, and alteration or modification of general aviation aircraft and/or aircraft equipment under the provisions of FAA approved guidelines; (c) The provisions of an FAA pilot flight and ground school training; and (d) Charter flight services, which may include aerial photography, advertising, map making, and crop dusting services.

Flared Intersection

A roadway that widens out at the intersection with another roadway, usually to accommodate thru lanes and additional turn lanes

Flood Plain

The relatively level land area on at least one side of a continuous elevated landform, such as a canal or railroad embankment, regularly subject to flooding. That part of the flood plain subject to a one-percent chance of flooding in any given year is designated as an "area of special flood hazard" by the Federal Insurance Administration.

Flood, 100-Year

The magnitude of a flood expected to occur on the average every 100-years, based on historical data. The 100-year flood has a 1/100, or one percent, chance of occurring in any given year.

Foundation line

"Foundation line" is defined as the outer perimeter of the base of a structure or building. In the case of a cantilever roof carport or similar building or structure not having an actual base, the base will be the perimeter as measured from two (2) feet inside of the edge of the roof of such building or structure.

Franchise

The same as defined under Article XIII of the Arizona Constitution.

Front of Lot

The front boundary line of a lot bordering on the street, and in the case of a corner lot, may be either frontage.

Frontage

All property on one (1) side of a street between two (2) intersecting streets (crossing or terminating) measured along the line of the street or, if the street is dead end, then all of the property abutting on one (1) side between an intersecting street or the dead end of the street, including property fronting on a cul-de-sac.

Garage

A building or portion thereof in, which a motor vehicle containing gasoline, distillate, or other volatile, flammable liquid in its tank is stored, repaired or kept.

Garage, Private

A building, or a portion of a building, not more than one thousand (1,000) square feet in area, designed primarily for the storage of motor-driven and/or recreational vehicles by the occupants of the buildings on the premises.

Garage, Service

A building or portion thereof, other than a private or storage garage, designed or used for servicing, repairing, equipping, hiring, selling or storing motor-driven vehicles.

Garage, Storage

A building or portion thereof designed or used exclusively for housing motor-driven vehicles and/or recreational vehicles.

General Aviation Specialty Shop

Two (2) or less of the following types of commercial activities: (a) Aircraft radio and accessories shop is a person, firm, or corporation engaged in an aircraft radio business, including sales, service, repair, exchange and installation of new and/or used aircraft radio equipment and parts which operate in accordance with FAA guidelines. (b) Aircraft instrument and accessories shop is a person, firm, or corporation engaged in aircraft instrumentation business, including sales, repair, exchange, and installation of new/or used aircraft instruments and parts which operate in accordance with FAA guidelines. (c) Flight school operator is a person, firm, or corporation engaged in a flight training school, limited to dual and solo flight training in fixed- or rotary-wing aircraft and such related ground school instruction as is necessary to prepare a student pilot to take a written examination and flight check ride for a pilot's license or appropriate aircraft rating from the Federal Aviation Administration, or its designee. (d) Aircraft and aircraft parts wholesale is a person, firm, or corporation engaged in the business of buying, selling and/or exchanging aircraft, aircraft parts, accessories, and hardware for other than retail trade. (e) Aircraft upholstery shop is a person, firm, or corporation engaged in the business of installing, replacing, and modifying or repairing aircraft interior upholstery and furnishings which operates in accordance with FAA guidelines. (f) Aircraft maintenance shop is a person, firm, or corporation engaged in the business of providing routine repair, overhaul, modification, and alteration and preventive maintenance for general aviation aircraft, which operates in accordance with FAA guidelines. (g) Used aircraft sales operator is a person, firm, or corporation engaged in the business of buying, selling, and exchanging of used general aviation aircraft. (h) Air taxi operator is a person, firm, or corporation engaged directly in air transportation of passengers and/or property subject to the provisions of part 135 of the Federal Aviation Regulations and holding a Certificate of Public Convenience and Necessity issued by the Arizona Corporation Commission.

General Plan

A compendium of city goals, objectives, and policies regarding its long-term development, in the form of maps and accompanying text.

Generator, Major

Any development (commercial, industrial, residential or mixed use) which generates more than 5,000 trips per weekday.

Goal

A general, overall, and ultimate purpose, aim, or end toward which the City will direct effort.

Grade

Ground level or the elevation at any given point.

Grade (adjacent ground elevation)

The lowest point of elevation of the finished surface of the ground, paving or sidewalk within the area between the building and the property line, or when the property line is more than five (5) feet from the building, between the building and a line five (5) feet from the building.

Grand Opening

The introduction, promotion or announcement of a new business, store, shopping center or office, or the announcement, introduction, or promotion of the changing of ownership of an established business.

Ground Level

The finished grade of existing sidewalk; or where there is no sidewalk, the street centerline elevation shall be the established ground level.

Groundwater Recharge

The natural process of infiltration and percolation of water from land areas or streams, or by artificial means, through permeable soils into water-holding rocks that provide underground storage ("aquifers").

Group Home

A facility which provides a living environment, sleeping rooms, and meals for any number or composition of residents, that does not meet the definition of "family" as set forth in this section. In addition to a place of residence and providing meals, the facility may offer resident support services, counseling, guidance, and varying levels of medical care. This definition shall not include group homes for developmentally disabled, as specifically defined and provided for by the Arizona Revised Statutes.

Guest Room

Any room or rooms used or intended to be used by a guest for sleeping purposes. Every one-hundred (100) square feet of superficial floor area in a dormitory shall be considered to be a guest room.

Hazard, Degree of

The term is derived from an evaluation of the potential risk to public health and the adverse effect of the hazard upon the potable water system. (a) Hazard, health: Any condition, device or practice in the water supply system and its operation which could create or in the judgment of the Director of Public Works may create a danger to the health and well-being of the water consumer. An example of a health hazard is a structural defect, including cross-connections, in a water system. (b) Hazard, plumbing: A plumbing type cross-connection in a consumer's potable water system that has not been properly protected by a vacuum breaker, air-gap separation or backflow prevention device. Unprotected plumbing type cross-connections are considered to be a health hazard. (c) Hazard, pollutant: An actual or potential threat to the physical properties of the water system or to the potability of the public or the consumer's potable water system but which would constitute a nuisance or be aesthetically objectionable or could cause damage to the system or its appurtenances, but would not be dangerous to health. (d) Hazard, system: An actual or potential threat of severe damage to the physical properties of the public potable water system or the consumer's potable water system or of a pollution or contamination which would have a protracted effect on the quality of the potable water in the system.

Hazardous Material

Any material or combination of materials which, because of its quantity, concentration, or physical, chemical or infectious characteristics, may pose a substantial or potential hazard to human health or the environment.

Heliport

An area of land or water or a structural surface which is used, or intended for use, for the landing and takeoff of helicopters, and any appurtenant areas which are used, or intended for use, for heliport buildings and other heliport facilities.

Hierarchy

A graded or ranked series.

High Noise Levels

Means sound levels, which equal or exceed that within the fifty-five-ldn noise contour line developed by the application of the day-night average sound level methodology of sound measurement (ldn).

Highway

Street as defined herein.

Highway

The full width of the right-of-way of any road, street, highway, alley, land or pedestrian walkway used by or for the general public, whether or not the road, street, highway, alley, land or pedestrian right-of-way has been improved or accepted for maintenance by the City. "Highway" also means and includes land which by deed, conveyance, agreement, easement, dedication, usage or process of law is reserved for or dedicated to the general public for street, highway, alley, public utility or pedestrian walkway purposes

Historic; Historical

An historic building or site is one that is noteworthy for its significance in local, state, or national history or culture, its architecture or design, or its works of art, memorabilia, or artifacts.

Home Occupation

Any occupation or profession conducted entirely within a dwelling unit and carried on by a member of the family residing therein and which occupation or profession is clearly incidental and subordinate to the use of the dwelling unit for dwelling purposes and does not change the character thereof, and in connection with which there are no employees other than a member of the immediate family residing in the dwelling unit; provided that no mechanical equipment is used except such that is normally used for domestic, hobby or household purposes; and provided that no commodity is sold upon the premises and provided that no inventory of saleable commodities are kept or stored upon the premises. "Home occupation" includes the use of a dwelling unit by a physician, surgeon, dentist, lawyer, clergyman or other professional person for consultation or emergency treatment, but not for the general practice of his/her profession. "Home occupation" does not include clinic, hospital, barbershop, beauty shop, animal hospital, advertising or public relations agency, interior decorator's office or workshop, real estate or insurance office, stockbroker's office or similar use.

Hospital

Unless otherwise specified, the term "hospital" shall include "sanitarium," "preventorium," "clinic," "maternity home" or "rest home" and shall be deemed to mean a place for treatment or other care of human ailments.

Hotel

Any building containing six (6) or more guest rooms intended or designed to be used, or which are used, rented or hired out to be occupied, or which are occupied for sleeping purposes by guests.

Housing and Urban Development, U.S. Department of (HUD)

A cabinet-level department of the federal government that administers housing and community development programs.

Illegal Sign

Includes any sign except the following: (a) A sign allowed by this chapter and not requiring a permit. (b) A sign allowed by this chapter with a permit and carrying a valid permit. (c) A sign not allowed by this chapter but which has been legalized by variance and proper permit. (d) A sign allowed by this chapter subject to a use permit, provided the use permit has been granted and a proper permit is in force. (e) A nonconforming sign as defined by this chapter.

Imminent Hazard

Any condition presenting an immediate likelihood for causing serious personal harm.

Impose

To determine that a particular development project is subject to the collection of development fees/charges as a condition of development approval.

In-fill Development

Development of vacant land (usually individual lots or left-over properties) within areas that are already largely developed.

In-home Day Care

An accessory use of a single-family residential dwelling, done by the person primarily using the dwelling as the person's dwelling unit, and which involves the providing of child care, on a regular or irregular basis, whether or not for compensation, for periods of less than twenty-four (24) hours per day, for not more than four (4) children through the age of twelve (12) years.

Indirect Lighting

A source of external illumination located a distance away from the sign, which lights the sign, but which is itself not visible to persons viewing the sign from any normal viewing position.

Industrial Fluids System

Any system containing a fluid or solution which may be chemically, biologically, or otherwise contaminated or polluted in a form or concentration such as would constitute a health, system, pollutant, or plumbing hazard if introduced into an approved water supply. This may include, but not be limited to: polluted or contaminated waters; all types of process waters and "used waters" originating from the public potable water system which may have deteriorated in sanitary quality; chemicals in fluid form, plating acids and alkalies, circulated cooling waters connected to an open cooling tower and/or cooling towers that are chemically or biologically treated or stabilized with toxic substances; contaminated natural waters such as from wells, springs, streams, rivers, urban lakes, irrigation canals or systems, etc., oils, gases, glycerine, paraffins, caustic and acid solutions and other liquid and gaseous fluids used in industrial or other purposes or for fire-fighting purposes.

Infestation

The presence of damaging or unhealthy numbers of insects, rodents or vermin.

Inoperable Vehicle

Any vehicle for which required license plates and/or tags have been expired or out of date for more than three (3) months; or that is partially or wholly dismantled, discarded, wrecked, on blocks or similar devices, stripped, or scrapped; or a vehicle with a deflated tire or tires or from which a wheel or tire has been removed; or any motor vehicle which is inoperable due to mechanical failure or mechanical disassembly.

Institution

A building or buildings occupied by a nonprofit corporation or a nonprofit establishment for public use.

Intensity of Lot Use

"Intensity of lot use" is defined as that portion of a lot or parcel of land which is covered by, or may be covered by, a building or structure, excluding the allowable two-foot overhang.

Intermediate Intersection

The intersection of any collector or local street or major driveway with any major or minor arterial functioning as the through roadway.

Internal Indirect Lighting

A source of illumination entirely within the sign visible at night by means of lighting the background upon which the freestanding character is mounted. The character itself shall be opaque, and thus will be silhouetted against the background. The source of the illumination shall not be visible.

Internal Lighting

A source of illumination entirely within the sign which makes the contents of the sign visible at night by means of the light being transmitted through a translucent material but where in the source of the illumination is not visible.

Intersection, Major

The intersection of any principal arterial (freeway or expressway) major or minor arterial with any major or minor arterial. These intersections are typically found at the section corners as the section-line roadways intersect. The intersection of two principal arterials normally requires an interchange

Irrigation Facilities

Includes canals, laterals, ditches, conduits, gates, pumps and appurtenant equipment necessary for the supply, delivery and drainage of irrigation water and the construction, operation and maintenance of such.

Junkyard

Means any land used for storage or for sale of scrap metal, waste paper, rags, non-operated vehicles or other junk materials and including noncommercial storage of non-operating and non-driveable motor vehicles, dismantling or storage of such vehicles or parts thereof, or used machinery, and regardless of whether repair or any other type of commercial operation occurs, but excluding scrap for use in manufacturing processes on the premises, or waste materials resulting from manufacturing processes, or resulting from the construction or elimination of facilities for such processes. An area including living plants, astro turf, walkways, ponds, fountains, sculpture and other organic and inorganic materials used for creating an attractive appearance and void of asphaltic or concrete pavement.

Land Banking

The purchase of land by a local government for use or resale at a later date. "Banked lands" have been used for development of low and moderate- income housing, expansion of parks, and development of industrial and commercial centers.

Land Split

The division of improved or unimproved land whose area is two and one-half (2 1/2) acres or less into two (2) or three (3) tracts or parcels of land or lots for the purpose of sale, lease or financing.

Land Use

The occupation or utilization of land or water area for any human activity or any purpose defined in the General Plan.

Large Single Use Retail

Any single use building, whether stand alone or within a multi-building development, wherein said single use building occupies at least one hundred fifty thousand (150,000) square feet of building coverage primarily devoted to, or intended for, the sale or display of goods and merchandise for consumption by the general public, including any outdoor sales and display area(s) and storage/stockroom area(s) but excluding any outdoor area for sale of cars, trucks, boats, recreational vehicles, or manufactured dwellings. For the purposes of this definition, calculation of such building coverage shall include all other indoor and outdoor sales areas or customer service area(s) that may be incidental to, but nevertheless share customer walking aisles or store entrances with the large single use retail operator, whether or not such area(s) are under the same management as the large single use retail operator.

Ldn

The day-night sound level.

Level of Service D - (LOS) D

A description of street capacity stating that no street shall operate above 80% of its planned capacity.

License

Any authorization granted under these licensing requirements or other sections of this Code, in terms of a privilege, permit, license or otherwise to construct, install, operate and/or maintain telecommunications facilities to provide telecommunications services, a fiber optic cable system, a cable television system or any other use in the City.

Loading Space

A permanently maintained space on the same lot as the main building accessible to a street or alley and not less than ten (10) feet in width, twenty (20) feet in length and fourteen (14) feet in height.

Lodging House

Any building or portion thereof, containing not more than five (5) guest rooms which are used by not more than five (5) guests where rent is paid in money, goods, labor or otherwise. A lodging house shall comply with all requirements of this Code for dwellings.

Lot

A piece or parcel of land separated from other pieces of parcels by description, as in a subdivision or on a record survey map or by metes and bounds, for purposes of sale, lease or separate use, and having frontage on at least one (1) street.

Lot

A piece or parcel of land separated from other pieces or parcels by description, as in a subdivision or on a record of survey map or by metes and bounds, for purposes of sale, lease, financing or separate use. Corner lot: (a) lot with frontage on two (2) or more intersecting streets. (b) Interior lot: A lot other than a corner lot. (c) Key lot: A lot adjacent to a corner lot, having its side lot line in common with the rear lot line of the corner lot and facing on the street which forms the side boundary of the corner lot. (See Appendix Figure 1.) (d) Through lot: (double frontage): A lot having frontage on two (2) or more nonintersecting streets.

Lot Area

The area of the lot, not including any area in a public way.

Lot Area, Net

Shall mean the area included within lot lines after all right-of-way dedications have been made as required by the Code of the City of Chandler.

Lot Lines

The lines bounding a lot.

Lot of Record

A lot which is part of subdivision, the plat of which has been recorded in the Office of the Clerk of Maricopa County Recorder's Office, or parcel of land, the deed of which is recorded in the Office of the County Recorder.

Lot width

The lot width shall be measured along a line which is parallel or tangent to the front property line, connecting two (2) points on the side lot lines which are located thirty (30) feet from the front lot corners.

Lot width

The horizontal distance between the side lot line thirty (30) feet behind the required front setback line and measured parallel to the front property line. (See Appendix Figure 2.)

Lot, Corner:

A lot with frontage on two (2) or more intersecting streets.

Lot, Depth of

The mean horizontal distance between the front and rear lot lines.

Lot, Interior

A lot other than a corner lot.

Lot, Key

A lot adjacent to a corner lot, having its side lot line adjacent to the rear lot line of the corner lot and facing on the street which forms the side boundary of the corner lot.

Lot, Through (double frontage)

A lot having frontage of two (2) or more nonintersecting public streets.

Maintenance

The replacing or repairing a part or portion of a sign made unusable by ordinary wear or tear, not exceeding fifty (50) percent of the sign's value, as determined by an appraiser.

Map of Dedication

A map used to separate land being dedicated to a public entity.

Marquee

A permanent roofed structure attached to and supported by the building and projecting over public property.

Master Plan

A plan for a large area that may address land use, landscaping, infrastructure, circulation or services provision.

Material Recovery Facility (MRF)

Any business or commercial establishment, which collects, sorts or processes material for the purposes of solid waste reuse or recycling.

Median

A raised or flush area designed to separate and control vehicular movement.

Metal Buildings

Any premanufactured structure with exterior walls of corrugated or ribbed metal panels.

Minor Land Division

Any division of improved or unimproved land or lands for the purpose of financing, sale, or lease, whether immediate or future, for which a subdivision plat is not required. A land split, a lot line adjustment and a map of dedication shall be considered minor land divisions.

Mixed-use

Properties on which various uses, such as office, commercial, institutional, and residential, are combined in a single building or on a single site in an integrated development project with significant functional interrelationships and a coherent physical design. A single site may include contiguous properties.

Mobile Home

A dwelling unit, factory-built and factory-assembled, designed for conveyance, after fabrication, on streets and highways on its own wheels or on flatbed or other trailers and arriving at the site where it is to be occupied as a dwelling unit complete and ready for occupancy, except for minor and incidental unpacking and assembly operations such as locating on jacks or other foundation, or connection to utilities. A prefabricated home or structure shall not be included in [this] definition.

Mobile Home Park

Any lot, tract or parcel of land used or offered for use in whole or part with or without charge for parking of mobile homes used for living or sleeping purposes.

Mobile Home Space

A plot of ground within a mobile home park designed for the accommodation of one (1) mobile home.

Mobile Home Subdivision

A subdivision designed and intended for residential use where residence is in mobile homes, exclusively.

Modular Housing

Any type of dwelling unit, excluding mobile homes, which may or may not be partially fabricated off the site and delivered to the building site for final assembling and construction. The construction of dwelling units must comply with all applicable building codes and inspections.

Motel

See "hotel" as defined in this Code.

Motor Home

Any motor vehicle designed as a self-contained mobile living unit. No such vehicle shall be occupied within the City of Chandler except as provided for by Article XI of this Code.

Neighborhood Drop-off-Sites

Designated sites throughout the City for the placement of containers for the collection of specified recyclable materials as determined by the Administrator.

Neighborhood Park

City-owned land intended to serve the recreation needs of people living or working within a one-mile area. Neighborhood parks serve as a neighborhood's recreational and social focus.

Neighborhood Park Zones Map

A map featured in the Parks and Recreation Master Plan Update 2000 that displays the service-areas for neighborhood parks.

Neighborhood Plan

A neighborhood plan is also known as an "area plan" and is a plan designed to guide development of the area and the platting of remaining vacant parcels in a partially built-up neighborhood so as to make reasonable use of all land, correlate street patterns and achieve the best possible land use relationships.

Noise Attenuation

Reduction of the level of a noise source using a substance, building material, or surface, such as earth berms and/or solid concrete walls.

Noise Level Reduction (NLR)

Means the difference in decibels of the noise level from outside to inside of a building, wherein such reduction depends primarily upon the construction and materials used in the walls, windows, ceilings, doors and vents of the building.

Nominal Service Area

A designated area that may vary from the actual area from which wastewater flows originate or contribute to the sanitary sewer system.

Nonconforming Use

Any building or land lawfully occupied by a use at the time of adoption of this Code or amendment thereto which does not conform after the adoption of this Code or amendment thereto with the use regulations of the district in which located.

Nonresidential Development Project

All development other than residential development projects.

Nude

Without opaque non-flesh-colored fabric fully covering the cleft of the buttocks, anus, pubic region, male genitals, female genitals, and female breasts below the top of the areola.

Off-site Construction

Construction, erection or installation or any change or addition to lands, structures, equipment, facilities or materials located above or below ground within any street, alley, easement or rights-of-way in the City. Off-site construction includes construction of improvements on private property which will later be dedicated to the City or which will serve as community infrastructure even though remaining private property.

Off-site Improvement

Improvements, infrastructure or facilities a developer is required to or does construct or install in conjunction with the development or redevelopment of any property and any off-site construction, including common infrastructure, adjacent to or related to property for which a City permit is being sought for purposes of development, redevelopment or construction. On-site retention basins and other drainage facilities, overhead utility lines, water lines or pipes four (4) or more inches in diameter, sewer lines or pipes eight (8) or more inches in diameter, together with water and sewer services and their appurtenances, shall be deemed off-site improvements as regulated by this chapter of the Code.

Open Dump

Any land publicly or privately owned, other than an approved sanitary landfill, on which there is a deposit and accumulation, either temporary or permanent, or any kind of organic or inorganic refuse, including but not limited to waste materials, waste products, wastepaper, garbage, empty cans, broken glass, rags, etc., but excluding scrap or materials for use in manufacturing processes on the premises.

Open Space

Land provided in subdivisions and other developments, which is necessary and desirable for recreational needs of residents of the neighborhood. Such space may be in the form of school-recreational centers, small parks, landscape areas, bikeways, stormwater retention areas, pathways or special street center islands.

Open Space

Any parcel or area of land or water that is improved or unimproved, and devoted to an open-space use for the purposes of (1) the preservation of natural resources, (2) the managed production of resources, (3) outdoor recreation, or (4) public health and safety. Open Spaces include functional open space, agriculture, retention/detention areas and floodways and floodplains. Open space may be publicly or privately owned and maintained.

Open Space Buffers

Open Space Buffers are typically tracts of private land used to separate different land uses. These areas generally include landscaping and may include topographic variations to meet retention or screening needs. These areas provide buffer between land uses and also contribute to visual open space and character within the community.

Open-air Ramada

A detached accessory building or structure open on the sides and supporting a roof or lattice-type cover, primarily for the purpose of providing shade in conjunction with a recreational activity, such as a swimming pool, jacuzzi, or sitting area, and not to exceed both ten (10) feet in height and one hundred fifty (150) square feet in area, and separated from the residential dwelling by a distance equal to at least one-half (1/2) of the rear yard setback.

Outdoor Recreation Use

A privately or publicly owned or operated use providing facilities for outdoor recreation activities. Space Which Can Be Enjoyed By People: This could include landscape plazas, grass, trees, fountains, sitting areas, etc., and is meant to provide an open garden atmosphere. Open space does not include parking areas, vacant or undeveloped lots. Entrance and/or exit drives may penetrate the open space areas. Open space also provides a landscape setting for all buildings or structures on a lot.

Outside Display

Any storage or display of merchandise, equipment, material, etc., which is located within a required setback area and not within or enclosed by a solid fence or masonry wall six (6) feet in height shall constitute an outside display.

Overhead Utility Lines

Lines historically conveyed by a series of conductors mounted on poles or other aboveground structures. Included are electric service lines, electric distribution lines (under sixty-nine (69) kilovolt), telephone cables and lines, and lines for other communications systems such as cable-transmitted television.

Owner

The person or persons holding title by deed to land, or holding title as vendees under land contract, or holding any other title of record.

Owner

Any person, agent, firm or corporation having a legal or equitable interest in the property.

Parapet Wall

A wall extending above the plat line of the building.

Park Land

Land that is publicly owned or controlled for the purpose of providing parks, recreation, or open space for public use. >Parks

Open space lands whose primary purpose is recreation, or passive enjoyment by the public.

Parking Lot, Permanent

A parcel of land improved in accordance with city standards and used for off-street parking purposes.

Parking Lot, Temporary

A parcel of land to be used for off-street parking purposes. Such use shall be temporary in nature as provided in Article XVIII, section 1801.

Parking Space (off-street)

A dust-free surfaced area, enclosed or unenclosed, providing for the storage and circulation of vehicles and for proper and safe ingress and egress thereto.

Paths and Trails

Trails and paths include on-street bicycle lanes, equestrian; multiple use paths and trails; pedestrian, equestrian and multiple use easements; and trailheads and staging areas. These facilities will continue to be publicly and privately owned and maintained. Trailheads may be privately or publicly owned and maintained, and may be constructed privately and dedicated to the City.

Patron

A person invited or permitted to enter and remain upon the premises of a sexually oriented business, whether or not for a consideration.

Pedestrian Way

A public walk dedicated entirely through a block from street to street and/or providing access to a school, park, recreation area or shopping center.

Planned Area Development (PAD)

A description of a proposed unified development, consisting at a minimum of a map and adopted ordinance setting forth the regulations governing, and the location and phasing of all proposed uses and improvements to be included in the development.

Planning and Development Director

The individual appointed by the City Manager to direct the affairs of the Planning and Development Department and to serve as staff advisor and administrative secretary to the Commission. A recording secretary may be appointed by the Planning Director to serve the Commission.

Planning and Zoning Commission

The duly appointed Commission authorized by this Code and appointed by the City Council.

Planning Area

The area directly addressed by the general plan. A city's planning area typically encompasses the existing city limits, and potentially annexable land which will ultimately form the City limits at built-out, and which the City will provide services.

Plat

A map of a subdivision. (a) Preliminary Plat, A preliminary map, including supporting data, indicating a proposed subdivision development, prepared in accordance with this chapter. (b) Final Plat, A map of all or part of a subdivision providing substantial conformance to an approved preliminary plat, prepared by a registered land surveyor in accordance with this chapter. (c) Recorded Plat, A final plat bearing all of the certificates of approval required by this chapter and duly recorded in the Maricopa County Recorder's Office.

Pollution

The presence of any foreign substance (organic, inorganic or biological) in water which tends to degrade its quality so as to constitute a hazard or impair the usefulness or quality of the water to a degree which does not create an actual hazard to the public health but which does adversely and unreasonably affect such waters for domestic use. >Porch

A covered but unenclosed projection from the main wall of a building which may or may not utilize columns or other ground supports for structural purposes.

Preliminary Approval

Approval of the preliminary plat by the Commission and Council as evidenced in its meeting minutes and noted upon prints of the plat; constitutes authorization to proceed with final engineering plans and final plat preparation

Principally Permitted Use or Structure

A use or structure which determines the primary or predominant use of the lot on which it is located.

Private Sewer Line or Private Sewer Main

Any sewer line not owned and maintained by the City.

Private Waterline

Any waterline not owned and maintained by the City.

Public Place

Any property owned, maintained or controlled by the City.

Public Sewer Line or Public Sewer Main

A sanitary sewer line owned and maintained by the City

Public Waterline or Public Water Main

A waterline owned and maintained by the City.

Public Waterline or Public Water Main

A waterline owned and maintained by the City.

Recharge

Water infiltrating to replenish an aquifer.

Reclaimed Water

Effluent which has been treated to achieve a quality suitable for its intended use as prescribed by Federal and State regulations.

Reclaimed Water

Effluent, other than effluent produced by the city's reverse osmosis plant, which has been treated to achieve a quality suitable for its intended use as prescribed by federal and state regulations.

Reclaimed water

Effluent, other than effluent produced by the City's reverse osmosis plant, which has been treated to achieve a quality suitable for its intended use as prescribed by federal and state regulations.

Reclaimed Water Distribution System, City

The network of public reclaimed waterlines which compose the basic grid and distribution system for reclaimed water service and all appurtenances thereto.

Reclaimed Water Service

City service to provide reclaimed water for commercial, recreational and landscaping purpose.

Reclaimed Water User, Large Volume

A developer who will receive a peak flow of two hundred fifty thousand (250,000) gallons of reclaimed water per day or more for all property within a zoning district at build out. This designation is not impacted by the number of meters, turnouts or contracts associated with delivery of reclaimed water to property within a zoning district.

Reclaimed Water Users, Small Volume

A developer who will receive a peak flow of less than two hundred fifty thousand (250,000) gallons of reclaimed water per day for all property within a zoning district at build out. This designation is not impacted by the number of meters, turnouts or contracts associated with delivery of reclaimed water to property within a zoning district.

Recreation, Active

A type of recreation or activity that requires the use of organized play areas including, but not limited to, softball, baseball, football and soccer fields, tennis and basketball courts and various forms of children's play equipment.

Recreation, Passive

Type of recreation or activity that does not require the use of organized play areas.

Recyclable Materials

Solid waste materials that are subject to collection for recycling purposes as determined by the Administrator and may include but are not limited to aluminum, newspaper, glass, plastic, tin/steel food cans, and cardboard.

Recycling Bin or Container

A City-provided receptacle for collection of recyclable materials only.

Regional

Pertaining to activities or economies at a scale greater than that of a single jurisdiction, and affecting a broad geographic area.

Reimbursement Agreement

An agreement executed between the City and developers for collection of buy-in assessments.

Reimbursement Agreement

An agreement executed between the City and developers for collection of buy-in assessments.

Reimbursement Agreement

Residence

Single-family homes, duplexes and triplexes.

Residential

Single-family homes, duplexes, and triplexes.

Residential Child Care

A single-family residential dwelling that is primarily used by the owner or party in legal possession as that person's principal dwelling unit, but which is also used by that person for an accessory use, namely, childcare and/or academic training for children, including pre-school, regularly provided for compensation, for periods of less than twenty-four (24) hours per day, for at least five (5) children but not more than ten (10) children, through the age of twelve (12) years.

Residential Development Project

Any development undertaken to create a new dwelling unit.

Residential Development Project, Multifamily

A residential development project in which more than one (1) dwelling unit is created in a single building.

Residential, Non-

Any structure which is not residential.

Responsible Person

An owner, tenant, renter, lessor, lessee, manager, agent, lienholder or any fiduciary or person with power of attorney or other person who is occupying or having charge, possession or control of the premises or has the authority and ability to act on behalf of, or in the interest of, the owner. When property is held in common by more than one (1) owner, each owner is a responsible person, even when a homeowner's association has been formed to manage and maintain such commonly owned property. Such a homeowner's association shall also be a responsible person. When any subdivision or planned area development (PAD) has been approved by Council and provisions have been made for the creation of an architectural review committee, homeowner's association or similar committee, which has been created, or will be created, for the purpose of controlling or regulating matters of common concern or maintenance, the developer of said subdivision or PAD shall submit to the City Clerk, the names, addresses and telephone numbers of the officers of said committee or association at the time the organization is granted autonomy. Until such information is supplies to the City Clerk, the developer shall remain a responsible person for purposes of maintaining all common property in accordance with this section. Once granted autonomy, the chairperson, secretary or principal officer of any committee or association, as described above, shall notify the City Clerk of any change in officers and provide the names, addresses and telephone numbers of the new officers within thirty (30) days after the change becomes effective. Until the City Clerk receives notice of any new officers the officers on record shall remain responsible persons as provided herein.

Retention/Detention Basins

Retention basins are principally designed to retain the runoff from a 100-year, 2-hour storm. These areas may be landscaped and used during non-storm periods for passive or active recreation. Any facilities placed in these areas require special care in placement to ensure that they are not inundated, except during the infrequent storm events.

Rezoning

An amendment to the adopted zoning map and/or text of a zoning ordinance to effect a change in the nature, density, or intensity of uses allowed in a zoning district and/or on a designated parcel or land area.

Riding Stable

A building and land where horses are boarded or kept for hire.

Right-of-way

A strip of land occupied or intended to be occupied by certain transportation and public use facilities, such as roadways, railroads, and utility lines.

Right-of-way

Any land which by deed, conveyance, agreement, easement, dedication, usage, zoning condition, process of law or other means is reserved for or dedicated to the general public for street, highway, alley, public utility, or pedestrian walkway purposes and accepted by the City.

Right-of-Way

The same as highway as defined herein above.

Roof Line

The height of the main roof structure but not to include cupolas, pylons, projections or other minor raised portions of the roof.

Rooming House

A dwelling, other than a hotel or motel, where two (2) or more rooms are rented.

Runway

Means a designated surface of land designated, paved and used at an airport for the landing and takeoff of aircraft.

Sanitary Sewer System

The public piping system which collects liquid and/or waterborne wastes defined as municipal wastewater, and conveys them to points of discharge or disposal.

School or College

Unless otherwise specified, any private or public place where general education instruction is offered on-site for any length of time, and does not include dancing schools, riding academies, or trade or specialized vocational schools.

Scrap Appliances, Used (white goods)

Includes, but is not limited to, refrigerators, washing machines, dishwashers, clothes dryers, microwave ovens, hot water heaters, water softeners, air conditioners, evaporative coolers and food freezers.

Scrap Metal of All Types

Old appliances or parts thereof, parts of motor vehicles, glass, paper, cardboard, old wood or lumber, old furniture and mattresses or any other material of little or no apparent economic value which is present in an obvious state of disarray.

Scrap Metals, Used

Ferrous and nonferrous metals accepted for the purposes of recycling (automobile bodies or frames are not included).

Screened/Screening

The concealment of unattractive land uses, such as storage areas or parking lots, from the public eye through the installation of landscaping, walls, fences, earth berms, or other devices as specified by the Zoning Code. Chain-link fencing with slats, vegetation or other material shall not be considered as screening under this definition.

Secondary Hauler

Any person, company or organization engaged in a business that generates, collects, removes or hauls solid waste as a by-product of its primary business. Secondary haulers would include, but not be limited to, carpet installers, roofing companies, landscape contractors or new construction clean-up removal contractors.

Service Line

A pipe carrying water from the public waterline to a water meter or other point of distribution

Service Line

A pipe carrying reclaimed water from the public waterline to a water meter or other point of distribution.

Service Station

A place of business engaged primarily in the retail sale of motor fuels and oils and in supplying goods and services generally required in the operation and maintenance of automotive vehicles. These may include sale of petroleum products; sale and servicing of tires, batteries, automotive accessories and replacement items; washing and lubrication services; the performance of minor automotive maintenance and repair; and the supplying of other incidental customer services and products directly related to the automotive vehicle. Painting, body and fender works are excluded.

Setback

The horizontal distance between the property line and any structure.

Sewer Line or Sewer Main

Any sewer line other than a building service line.

Sewer Service Area

The area contributing wastewater to the sanitary sewerage system or portion thereof.

Sewer, Interceptor

A sanitary sewer eighteen (18) inches in diameter or larger that receives flow from a number of sewers and transports the flow to a point for treatment or disposal.

Sewer, Lateral

A sanitary sewer of fifteen-inch diameter or smaller that discharges into a branch or other sewer and has no other common sewer tributary to it.

Sewer, Trunk

A sanitary sewer eighteen (18) inches in diameter or larger that receives flow from many tributary branches and services a large area.

Sexually oriented business

An adult bookstore, an adult services business, an adult video facility, or any combination of the foregoing.

Sign

Any visual communication which is used to attract the attention of the public, when the display is visible beyond the boundaries of the property.

Sign

Sign Area

The entire area within a single continuous perimeter of the sign or any existing border of the sign; to exclude the necessary supports or uprights on which the sign is placed. In any event, composition of allowable sign area includes all existing signs on the premises, whether such signs can be conforming or nonconforming under the terms of this chapter. Where a sign is double-faced or V-shaped, only the larger single face shall be used to determine sign area.

Sign, Change Panel

A sign designed to permit immediate change of copy, which may be other than the name of the business.

Sign, Directory

A sign designed to show the relative locations of tenants in the shopping center or other multi-tenant development and/or building.

Sign, Freestanding

A sign which is supported by one (1) or more uprights or poles, and braced in or upon the ground.

Sign, Height

The distance measured from ground level to the top of the sign.

Sign, Low-profile

A sign not exceeding a six-foot height above ground level.

Sign, Nonconforming

Any sign, which is not permitted by this chapter, but which, when first constructed, was legally permitted by the City or the political subdivision then having jurisdiction and regulation over construction of signs.

Sign, On-site

A sign which correctly identifies a business, commodity, service or entertainment conducted, sold or offered on the same premises as those upon which the sign is located, whether an attached sign or freestanding sign, and which may include other non-changeable information that further identifies the type of business, commodity, service, or entertainment offered therein, including addresses and phone numbers.

Sign, Permanent

Any sign constructed and intended to be of an enduring and lasting condition, remaining unchanged in character, condition (beyond normal wear) and position.

Sign, Portable

Any sign not permanently attached to the ground or to a structure on the property it occupies.

Sign, Projecting

Any sign attached to a building or other structure and extending in whole or in part beyond the building line.

Sign, Temporary

Any sign, banner, pennant, valance or advertising display constructed of cloth, canvas, light fabric, cardboard, wallboard, or other like materials, with or without frames, intended to be displayed for a short period of time as defined in this chapter.

Sign, V-shaped

Signs erected upon common or separate structures which present a V-shape appearance and having an exterior angle between faces of not more than forty-five (45) degrees with a distance between faces of such signs at their closest point not exceeding two (2) feet.

Sign, Vehicle

Any sign mounted or painted upon or otherwise erected on a trailer, truck, automobile or other vehicle so parked or placed so that the signs thereon are visible from a public street or right-of-way.

Sign, Window

Any permanent sign affixed to the interior or exterior of a window so as to attract the attention of persons outside the building.

Single-family Dwelling

A building located upon a separate lot, designed for occupancy by one (1) family for living purposes. Single-family dwelling shall include a mobile home located upon a lot in a mobile home subdivision. Single-family dwelling shall also include a condominium or townhouse, which has a separate water meter.

Site

A parcel of land used or intended for one use or a group of uses and having frontage on a public or an approved private street.

Solid Waste

Any unwanted or discarded material that is not a liquid or gas. Includes organic wastes, paper products, metals, glass, plastics, cloth, brick, rock, soil, leather, rubber, yard wastes, and wood, but does not include sewage and hazardous materials.

Solid Wastes (consisting of both combustible and noncombustible Wastes)

Such as paper, wrappings, weeds, cigarettes, cardboard, tin cans, yard clippings, leaves, tree trimmings, metal, wood, glass, bedding, crockery, construction materials and similar materials of little or no economic value.

South Price Road (high-tech) Campus Employment Corridor.

That area south of Willis Road, as depicted on the Chandler Land Use Map for that area, represents Chandler's premier high tech corridor. It's environment would be defined by single users such as high-tech manufacturing, research and development, and corporate offices in integrated campus-like setting on parcels generally not less than 15 acres. Streetscape appearances would also be characterized by large landscaped setbacks utilizing turf, berms, and other landscape themes. General industrial parks and subdivisions, warehousing, distributorships, and other non high-tech users do not fit in this definition.

Special Request Recovered Water

Recovered reclaimed water delivered directly from a recovery well for the exclusive use of a single user.

Special Use Commercial

These are places characterized and designed to be pedestrian friendly activity areas that support a mix of retail and commercial services uses and attract visitors. These areas denote a high level of visual interest and are characterized by providing an attractive urban environment. They may include restaurants, retail shops, entertainment and recreational uses, offices, and plazas in an urban setting. They may also include higher density residential projects as part of an approved, mixed-use area plan. Appropriate locations would be along waterways or near lakes, appropriate in-fill areas, downtown, or as complementary support destinations near larger commercial centers. They may be developed in areas to complement nearby conventional retail development, as exemplified by Casa Paloma or as stand-alone uses such as The Falls at Ocotillo, which take advantage of nearby lakes, and water features that complement the pedestrian experience. Other examples include the Sun Tech Village Shops, and The Boardwalk at Andersen Springs.

Special Use Parks and Facilities

Special use facilities and sports field facilities are planned to be publicly or privately owned and maintained. They are designed and maintained to meet specific community needs. They may include skate parks, aquatic centers, riparian habitat preserves, dog parks, and equestrian centers.

Specified Anatomical Areas

The cleft of the buttocks, anus, pubic region, male genitals, female genitals, or female breast below the top of the areola that are less than completely and opaquely covered by nonflesh-colored fabric; or human genitals in a state of sexual arousal, even if completely and opaquely covered.

Specified Sexual Activities

Actual or simulated sexual intercourse, masturbation, oral copulation, sodomy, flagellation, bestiality, fondling or other erotic touching of human genitals, pubic region, buttocks, anus or the female breast, or any combination of the foregoing.

Storage Shed

A subordinate structure or building used primarily for storage purposes, of a height no greater than seven (7) feet, and the total square footage of which does not exceed one hundred twenty (120) square feet.

Story

That portion of a building included between the upper surface of any floor and the upper surface of the floor next above, except that the topmost story shall be that portion of a building included between the upper surface of the topmost floor and the ceiling or roof above. If the finished floor level directly above a basement, cellar or unused under-floor space is more than six (6) feet above grade as defined herein for more than fifty (50) percent of the total perimeter or is more than twelve (12) feet above grade as defined herein at any point, such basement, cellar or unused under-floor space shall be considered as a story.

Street

The same as highway as defined herein above.

Street

Any existing or proposed street, highway, avenue, boulevard, road, parkway, place, bridge, viaduct or easement for public vehicular access or a street shown in a plat heretofore approved pursuant to law or a street in a plat duly filed and recorded in the County Recorder's Office. A street includes all land within the street right-of-way, whether improved or unimproved, and includes such improvements as pavement, shoulders, curbs, gutters, sidewalks, parking space, bridges and viaducts. (a) Freeway A divided major thoroughfare having controlled access to adjoining property and designated as such on the transportation plan. (b) Arterial street A major street of exceptional continuity that is intended to carry the greater portion of through traffic from one 1) area of the City to another. (i) Major arterial street Provides continuity for the intercity travel through urban areas and serve most of the mid to long distance trips within the City. (ii) Minor arterial streets These typically accommodate trips of shorter length than major arterials. These facilities interconnect uses on a community level and are designated in corridors that have lower traffic demand than major arterials. (c) Collector street A street designed to accommodate traffic within residential neighborhoods with their primary purpose of collecting and distributing traffic to and from the arterial streets. (d) Local street A street which has limited continuity with the primary purpose of serving property that is adjacent to the street. (e) Cul-de-sac A short local street having but one (1) end open for vehicular traffic, the opposite end being terminated with a permanent turnaround. (f) Marginal-access street (frontage road) A minor service street which parallels and is immediately adjacent to an arterial street or freeway.

Street

Street Line

A dividing line between a lot, tract or parcel of land and a contiguous street (right-of-way).

Street, Private

A street not owned or maintained by the City.

Structural Alterations

Any change in the supporting members of a building, such as bearing walls or partitions, columns, beams or girders, or any complete rebuilding of the roof.

Structure

That which is built or constructed, an edifice or building of any kind, or any piece of work artificially built up or composed or parts joined together in some definite manner.

Subdivider

A person, firm, corporation, partnership, association, syndicate, trust or other legal entity that files application and initiates proceedings for the development or any division of land in accordance with the provisions of this Code.

Subdivision

The division of a tract of land into defined lots, either improved or unimproved, which can be separately conveyed by sale or lease, and which can be altered or developed.

Subdivision

Improved or unimproved land or lands divided for the purpose of financing, sale or lease, whether immediate or future, into four (4) or more lots, tracts or parcels of land, or if a new street is involved, any such property which is divided into two (2) or more lots, tracts or parcels of land, or any such property, the boundaries of which have been fixed by a recorded plat, which is divided into more than two (2) parts. "Subdivision" also includes any condominium, cooperative, community apartment, townhouse or similar project containing four (4) or more parcels, in which an undivided interest in the land is coupled with the right of exclusive occupancy of any unit located thereon, but plats of such projects need not show the buildings or the manner in which the buildings or airspace above the property shown on the plat are to be divided.

Subdivision

(a) Improved or unimproved land or lands divided for the purpose of financing, sale or lease, whether immediate or future, into four (4) or more lots, tracts or parcels of land; or (b) If a new street or new private roadway easement is involved, any division of a parcel of land; or (c) Any such property, the boundaries of which have been fixed by a recorded plat, which is divided in any way, which creates a new lot. "Subdivision" also includes Any condominium, cooperative, community apartment, townhouse or similar project containing four (4) or more parcels, in which an undivided interest in the land is coupled with the right of exclusive occupancy of any unit located thereon; but plats of such projects need not show the buildings or the manner in which the buildings or airspace above the property shown on the plat are to be divided. Subdivision does not include: (a) The sale of exchange of parcels of land to or between adjoining property owners if such sale or exchange does not create additional lots. (b) The partitioning of land in accordance with other statutes regulating the partitioning of land held in common ownership. (c) The leasing of apartments, offices, stores or similar space within a building or trailer-park, nor mineral, oil or gas leases.

Subdivision Review Committee

A Committee established to review proposed development plans preliminary subdivision plats, land splits and minor land divisions.

Subsidize

To assist by payment of a sum of money or by the granting of terms or favors that reduce the need for monetary expenditures. Housing subsidies may take the forms of mortgage interest deductions or tax credits from federal and/or state income taxes, sale or lease at less than market value of land to be used for the construction of housing, payments to supplement a minimum affordable rent, and the like.

Swimming Pool

Any outside body of water, above or below ground, created by artificial means, which is designed or used for swimming or immersion purposes, any portion of which exceeds eighteen (18) inches in depth.

Telecommunications

The transmission, between or among points specified by the user, of information of the user's choosing, without change in the form or content of the information as sent and received. The term does not include commercial mobile radio services, pay phone services, interstate services or cable services.

Telecommunications Corporation

Any public service corporation to the extent that it provides telecommunications services in the state.

Telecommunications Provider

Telecommunications corporation, who constructs, installs, operates and maintains telecommunications facilities in the City.

Telecommunications Services

The offering of telecommunications for a fee directly to the public or to such users as to be effectively available directly to the public, regardless of the facilities used.

Tract

An area of land that has not been subdivided.

Traffic Calming Measure

Designs implemented in local streets to minimize the impact of high speed, through traffic upon sensitive neighborhood areas.

Trailhead

The beginning point of a trail and includes parking, trail information, rubbish containers, water and sanitary facilities.

Trails, Multi-modal

Multi-modal trails are hard surface trails designed for all types of non-motorized transportation. Signs, crossings, vegetation, rest and staging areas developed in conjunction with these paths are also primarily designed for non-motorized recreation

Transfer Facility

The meaning set forth in State law. [See A.R.S. 49-701]

Transient Service Facility

An establishment where the principal function involves providing on-site food, clothing, shelter, employment or other related services primarily intended for transient populations with limited ability for self care, or those persons in need of counseling for employment, or those persons with personal or behavioral disabilities. The term shall include the principal assistance or service facility and all appurtenant or related establishments intended for use by the patrons of the principal facility. The term shall include homeless shelters, charity dining facilities, plasma centers, rescue missions, day labor hiring centers, and similar facilities, but shall not include State licensed care facilities such as homes for the developmentally disabled, child crisis, and domestic violence centers.

Transmission Main

A public waterline generally larger than sixteen (16) inches in diameter.

Transportation Plan

An element of the Chandler General Plan, adopted by the City Council, which indicates major streets, parkways, railroads and other transportation facilities. >Travel Trailer

A mobile home not exceeding eight (8) feet in width nor more than thirty-three (33) feet in length. No such unit shall be occupied within the City of Chandler except as provided for in Article XI of this Code.

Underground or Undergrounding

The placement of utilities at or below ground with the attendant removal of aboveground poles, conductors and appurtenances as applicable.

Uniform Building Code

The edition of the Uniform Building Code adopted for use by the City.

Usable Lot Area

That portion of a lot usable for or adaptable to the normal uses made of residential property, excluding any areas which may be covered by water, excessively steep, or included in certain types of easements.

Use

The purpose of (for) which land or building is occupied, or maintained, arranged, designed or intended.

Use, Accessory

A subordinate use of building or land, customarily incident to and conducted on the same lot with the principal use.

Utilities

Domestic water, reclaimed water, sewage disposal service and garbage and refuse collection.

Utilities

Installations of facilities, underground or overhead, furnishing for the use of the public: electricity, gas, steam, communications, water, drainage, sewage disposal or flood control, owned and operated by any person, firm, corporation, or municipality duly authorized by State or municipal regulations. Utility or utilities as used herein may also refer to such persons, firms, corporations, departments or board, as sense requires.

V/C Case Type Materials

Those which have a flame spread rating of two hundred twenty-five (225) or less when tested in accordance with Uniform Building Code Standard No. 42-1 in the way intended for use or a smoke density rating no greater than seventy-five (75) when tested in the thickness intended for use by the Chamber Method of Test under Uniform Building Code Standard No. 52-2. The products of combustion shall be no more toxic than those of untreated wood when burned under similar conditions.

Waste, Hazardous

The meaning set forth in State law. [See A.R.S. §§ 49-921 (5); 49-901; 49-701.01 B(1).]

Waste, Household Hazardous

The meaning set forth in State law. [See A.R.S. § 49-701 (13).]

Waste, Municipal Solid

The meaning set forth in State law. [See A.R.S. 49-701.01]

Waste, Residential

Solid waste generated at a residence.

Waste, Special

The meaning set forth in State law. [See A.R.S. 49-851 A(5)]

Wastes, Unacceptable

Any waste material, which cannot be collected, landfilled or recycled in accordance with good standard practices or local, State and Federal law prescribing what materials may be accepted at the City's landfill. These wastes may include but not be limited to hazardous, infectious or toxic wastes and other noxious wastes such as ash, broken glass, dust, sawdust, kitty litter and loose fiberglass.

Wastewater, Municipal

The untreated wastewater originating from a mixture of domestic, commercial and industrial sources.

Water Service Connections

The terminal end of a service connection from the public potable water system, i.e., where the City loses jurisdiction and sanitary control over the water at its point of delivery to the customer's water system. If a meter is installed at the end of the service connection, then the service connection shall mean the downstream end of the meter. There should be no unprotected takeoffs from the service line ahead of any meter or backflow prevention device located at the point of delivery to the customer's water system. Service connection shall also include water service connection from a fire hydrant and all other temporary or emergency water service connections from the public potable water system. However, except in the case where residential homes incorporate the use of reclaimed wastewater as a water conservation measure, the service connection shall be at the pipe union located beyond the approved backflow prevention device. There shall be no connections made upstream of the pipe union. The City system shall include all piping between the water meter and the pipe union, including the backflow prevention device.

Water Service, Municipal

Water service provided for domestic, commercial, recreational, and landscaping purposes.

Water, Nonpotable

Water which is not safe for human consumption or which is of questionable potability.

Water, Potable

Any water which, according to recognized standards, is safe for human consumption.

Water, Used

Any water supplied by the City from a public potable water system to a consumer's water system after it has passed through the point of delivery and is no longer under the sanitary control of the City.

Weeds

Any vegetation which attains such large or uncontrolled growth as to become, when dry, a fire hazard or menace to adjacent property. Vegetation, in excess of six (6) inches, growing in an uncontrolled manner which will, if not cut or destroyed, become a fire hazard or menace to adjacent property.

Wildlife

Animals or plants existing in their natural habitat.

Xeriscape

A form of desert landscaping that conserves water by utilizing low-water plants and minimizing the use of turf (grass) for lawns.

Yard

An open, unoccupied space, other than a court, unobstructed from the ground to the sky, except where specifically provided by this Code, on the lot on which a building is situated.

Yard, Front

A yard extending across the full width of the lot, between the front lot line and the front wall of the principal building.

Yard, Rear

A yard extending across the full width of the lot between the rear lot line and the rear foundation wall of the principal building.

Yard, Side

A yard extending from the front yard to the rear yard, between the side lot line and the side foundation wall of the principal building.

Zoning

The division of a city or county by legislative regulations into areas, or zones, which specify allowable uses and required development standards for real property within these areas; a program that implements policies of the General Plan

Zoning Administrator

The person appointed and responsible for the enforcement of the Zoning Code.
